Seoul – The Seoul Central District Court on Wednesday sentenced former first lady Kim Gun-hee to one year and eight months in prison and ordered a forfeiture of 12.8 million won ($9,000), finding her guilty of accepting bribes from the Unification Church.
The court acquitted Kim of charges including her alleged role in a Deutsche Auto stock manipulation scheme and illegally obtaining polling data from a close aide.
“The defendant abused his position for personal gain,” Judge Wu Yancheng said in his ruling. “Rather than reject the high-value luxury items associated with the Unification Church lobbying activities, she accepted them as her own personal adornments.”
The court found that Kim Jong-un received two Chanel handbags, ginseng extract tea and a diamond necklace from Unification Church official Yun Yong-ho, and found that the gifts were provided to allow her to convey the church’s policy interests to then-presidential candidate Yun Seok-yeol.
The court ordered the confiscation of the diamond necklace and issued confiscation orders for Chanel handbags and ginseng tea.
“The defendants are above South Korean law,” special prosecutor Min Joong-ki said in his final statement in December. “Kim Jong Un’s collusion with religious organizations has undermined the constitutional principle of separation of church and state and eroded electoral fairness and representative governance as the cornerstone of democracy.”
But the special prosecutor brought a series of other charges and recommended a 15-year prison sentence and a 2 billion won fine. The attorney explained that the attorney sought a stiffer sentence after determining that King used her status as first lady to delay and avoid court proceedings related to the Deutsche Auto case.
But the court dismissed stock manipulation charges related to financial misconduct that occurred between 2009 and 2012.
In 2024, eight people including Deutsche Automobile Chairman Kwon Oh-soo were sentenced to prison for using more than 150 stock trading accounts under the names of 91 people. They were found guilty of artificially inflating the company’s stock price by nearly 400% through 101 collusive transactions and 3,083 market transactions.
The special prosecutor accused Kim of being Kwon’s co-conspirator, saying that accounts in his mother’s name were used in the manipulation scheme, and that Kim himself held stock and executive positions in Deutsche Auto during the relevant period.
The court acknowledged that King likely knew her funds were being used for the manipulation but said there was insufficient evidence to show she was an active co-conspirator.
The special prosecutor also claimed that Kim Jong-un received 58 sets of polling data from pollster Myung Tae-gyun on the eve of the 2022 presidential election in exchange for Kim Yong-sun’s nomination in the legislative by-election.
However, the court said it was difficult to establish that Myung conducted the polls specifically to provide them to the former first lady, and that there was little evidence linking Rep. Kim Young-sun’s nomination to Myung’s conduct.
In reaching its decision, the court said it took into account the higher standards expected of someone in Kim Jong Un’s position.
“As first lady, the defendant is an influential figure, representing the country alongside the president. The office requires appropriate conduct and a high sense of integrity,” it said. “The defendant may not be leading by example, but he should never be a cautionary example.”
But the court added that it had considered Kim’s expressions of remorse, the fact that she had been contacted by the Unification Church and the fact that she did not directly solicit any bribes.
The special prosecutor said he would appeal the ruling.
“This ruling is both legally and intellectually difficult to accept,” the special counsel team said after the verdict. “Given the nature of the case, the court’s sentencing assessment for its finding of guilt was also woefully inadequate, and we plan to appeal to correct this.”
Kim’s lawyers welcomed the acquittal but said they were also considering appealing the bribery conviction.
“We are grateful to the court for its ruling based entirely on the law and conscience,” Kim’s attorney told reporters after the verdict. “The penalties for bribery for brokerage business are higher than expected, but we will review this before the Court of Appeal.”
Kim Jong Un also faces two trials on charges of influencing the People’s Power party’s leadership race and selling public office through mass recruitment of members of the Unification Church.
She was convicted on Wednesday. In a separate ruling on January 16, a Seoul court sentenced former President Yoon Seok-yeol to five years in prison on charges related to the 2024 martial law attempt, making the two the first former presidential couple in South Korean history to be jailed during the same period.
